As of June 2026 — "Trump tariffs" is the collective term for the US import tariffs imposed since 2025 during President Donald Trump's second term. The core was initially a system of so-called reciprocal tariffs (Liberation Day, April 2025) with a 10 percent baseline rate and higher country-specific surcharges of up to 50 percent, based on the emergency-powers statute IEEPA. On 20 February 2026 the US Supreme Court ruled these IEEPA tariffs unlawful, since the Constitution assigns the tariff power to Congress. The administration replaced them under Section 122 of the Trade Act of 1974 with a temporary surcharge on virtually all imports — initially 10 percent, raised by order of 22 February 2026 to the statutory maximum of 15 percent (Proclamation 11012 of 20 February 2026, effective 24 February, max. 150 days, expiring 24 July 2026 absent extension by Congress); the Court of International Trade (CIT) held this basis unlawful too on 7 May 2026 (reasoning: the proclamation failed to identify the balance-of-payments deficit required by the statute). The Federal Circuit issued an administrative stay (11 June 2026) pausing enforcement of the CIT ruling, so collection continues for now (appeal pending). Unaffected are the sectoral tariffs under Section 232 (including steel, aluminium and copper at 50 percent each, vehicles at 25 percent) and the Section 301 tariffs on China. Negotiated rates of 15 percent apply to both the EU and Switzerland. The legal situation is volatile; specific rates should be checked before every import.
