Definition & Explanation

As of June 2026. Semiconductor tariffs are the U.S. import duties levied under Section 232 of the Trade Expansion Act of 1962 on semiconductors (chips), semiconductor manufacturing equipment and their derivative products. They originate in a Section 232 investigation opened by the U.S. Department of Commerce on 1 April 2025; its final report (22 December 2025) found semiconductor imports to threaten national security. By presidential proclamation of 14 January 2026 (Proclamation 11002), President Trump imposed a 25% duty, effective 15 January 2026. Initially only a narrowly defined set of advanced logic chips is covered (HTS 8471.50, 8471.80, 8473.30 above defined processing-performance and DRAM thresholds; cited examples include the Nvidia H200 and AMD MI325X). Chips for U.S. data centers above 100 MW are exempt (HTS 9903.79.03). In late January 2026 Washington also concluded a trade pact with Taiwan granting preferential treatment to Taiwanese exports other than semiconductors; companies building U.S. semiconductor plants may import duty-free up to 2.5× their planned U.S. capacity during construction and 1.5× after completion. USTR and Commerce were to report by 14 April 2026 on a possible "Phase 2" against the main fabrication countries Taiwan, South Korea and Japan, with a separate report on the data-center semiconductor market due by 1 July 2026. A broad expansion had not been finalized as of June 2026. Not to be confused with the Section 301 tariffs on chips from China or the Section 232 steel, aluminum and copper tariffs; semiconductor tariffs may overlap with other measures (see tariff stacking).
