recourse claim

Unlike a primary damages claim, a recourse claim presupposes that the claimant has already paid compensation on behalf of another – it is a right of recovery against the party actually liable.

Unlike a primary damages claim, a recourse claim presupposes that the claimant has already paid compensation on behalf of another – it is a right of recovery against the party actually liable. A recourse claim entitles one party to recover from another the amounts paid as indemnity or compensation that the other party should have borne. In freight and logistics, a carrier or forwarder typically asserts a recourse claim after settling a loss with the consignee and then turning to the party at fault – such as a shipper whose defective packaging caused the damage, or a negligent subcontractor. Recourse differs from direct liability in that payment by the claimant is a precondition. Limitation periods for recourse claims vary by applicable transport law (e.g. CMR, national commercial codes), making prompt documentation of all loss payments essential.
