Definition & Explanation
Non-preferential origin, often called trade-policy origin or made-in origin, determines which country goods originate from for customs purposes when no tariff preferences are involved. In the EU, Article 60 of the Union Customs Code applies: the country of origin is where the goods were wholly obtained or underwent their last substantial, economically justified processing or working. Non-preferential origin governs the application of trade-policy measures such as antidumping duties, additional tariffs and punitive tariffs (for example US measures under Section 301), embargoes and quotas, as well as certificates of origin and origin marking. For freight forwarders and customs declarants, it is – alongside the tariff classification number – the central criterion for calculating import duties, especially when country-specific tariffs change at short notice. Not to be confused with preferential origin, which determines eligibility for reduced duty rates under free trade agreements and follows its own, stricter rules.
