As of June 2026. Substantial transformation is the core test in US customs law for determining a product's non-preferential country of origin – and therefore which of the country-specific Trump tariff rates (such as the reciprocal tariffs or country-based additional duties) actually applies. Ever since the landmark ruling Anheuser-Busch v. United States (1907), the decisive question is whether processing in the last country of production creates a new article with a distinct name, character and use; for goods from Canada and Mexico, US Customs (CBP) additionally applies the tariff-shift rules of 19 CFR Part 102. The test matters above all in combating so-called origin laundering: merely transiting or lightly processing Chinese inputs through Vietnam, Malaysia or Mexico does not change origin and triggers penalties such as the transshipment tariff. Not to be confused with preferential rules of origin (e.g. USMCA qualification) or tariff engineering: the former lower duties via free-trade agreements, the latter optimises HTS classification. Section 232 sector tariffs (steel, aluminium, copper) apply their own material-based origin tests.
