In international trade, the notice of defects period is the timeframe within which a buyer or consignee must report defects or damage in writing, failing which warranty and guarantee claims typically lapse. The length of this period is set by the sales contract, applicable law, or trade custom, and varies considerably depending on context. Transport law often imposes significantly shorter deadlines than general contract law: for visible damage to ocean freight, notification may be required at the time of delivery; for concealed damage, different periods apply depending on the convention governing the shipment. Freight forwarders must also be aware of these deadlines in their own right, as they act as receiving agents and must notify carriers promptly to preserve recourse rights. Oral notification is generally insufficient in cross-border transactions—written documentation is the prerequisite for any successful claim.
