Montreal burden of proof

A term describing the allocation of the burden of proof in international air transport claims under the Montreal Convention (1999). In practice, the claimant (shipper/consignee or passenger) must prove the damage and causation; the carrier may rely on defenses. The rule establishes liability parameters and limits as set out by the Montreal Convention.
