Liability for Rolled Cargo

A carrier is obliged to secure cargo during transport so that it does not roll or shift; failure to do so exposes the carrier to liability.

A carrier is obliged to secure cargo during transport so that it does not roll or shift; failure to do so exposes the carrier to liability. Rolled cargo refers to damage arising when goods move or roll within the vehicle due to inadequate securing, poor stowage, faulty load planning, or insufficient packaging. Liability is capped by statute or contract (e.g., under the CMR Convention) and may be excluded if the shipper was negligent in packing or declaring the goods. In freight forwarding practice, rolled cargo claims rank among the most common damage disputes in general cargo operations.
