In rules-of-origin law, the question of substantial processing or treatment arises whenever it must be established whether a production step is sufficient to confer originating status on goods in the processing country. The determining factor is whether the operations performed fundamentally alter the essential characteristics, value, or functionality of the goods—not merely their appearance. Simple assembly of pre-made parts, basic filling operations, or repackaging generally do not qualify and therefore do not establish origin. Assessment draws on criteria such as a change in tariff classification, a minimum value-added threshold, or specific processing requirements, depending on the applicable preferential agreement. For exporters and freight forwarders, this classification has direct consequences: it governs whether preferential duty rates can be claimed and what supporting evidence must be presented to customs. Closely related but distinct is the concept of last substantial processing or treatment, which applies specifically to determining the country of origin in multi-country production scenarios.
