Definition & Explanation
Unlike the European ADR agreement or the IMO's IMDG Code, the Hazardous Materials Transportation Act (HMTA) is the primary U.S. federal statute governing the movement of hazardous materials across all transport modes—road, rail, water, and air. Administered and enforced by the Pipeline and Hazardous Materials Safety Administration (PHMSA), the Act establishes national standards for classification, packaging, labeling, documentation, and personnel training. Any freight forwarder, carrier, or shipper operating in or to the United States must comply; violations can result in civil penalties, shipment refusals, and heightened regulatory scrutiny. While HMTA and ADR share overarching safety objectives, their classification structures and marking requirements diverge in ways that matter in practice—particularly for transatlantic or multimodal shipments where both frameworks apply.
