The Hamburg Rules establish the framework for carrier liability in sea freight under the United Nations Convention on the Carriage of Goods by Sea, adopted in 1978. Compared to the Hague Rules of 1924, they shifted certain evidentiary burdens in favour of shippers and raised the carrier's liability limits. Under the Hamburg Rules, carriers bear liability for proven loss or damage unless they can demonstrate that all reasonable measures were taken—a broader obligation than the catalogue of exceptions permitted under the Hague regime. In practice, the Hague-Visby Rules remain the dominant standard in major maritime nations, while the Hamburg Rules are primarily in force across a number of developing countries; the Rotterdam Rules of 2009 have so far attracted limited ratification. Forwarders and shipowners must identify the applicable convention for each contract, as liability caps and exemption clauses differ substantially across regimes.
