Definition & Explanation

An importer is asked by customs to show under what conditions its goods were produced at the origin factory – the trigger is a forced labour import ban. The term covers trade rules prohibiting the placing on the market or importation of goods made wholly or partly with forced labour. In the United States the Uyghur Forced Labor Prevention Act applies a rebuttable presumption of forced labour to goods linked to Xinjiang and puts the burden of proof on the importer. In the EU, Regulation (EU) 2024/3015 bans such products from 14 December 2027, but forgoes any regional presumption and has authorities investigate on a risk basis instead. For forwarders this raises the bar on supply-chain evidence. Not to be confused with general supply-chain due-diligence duties, which do not by themselves stop an import.
