Shippers, consignees, and freight forwarders turn to a damages claim in court when out-of-court negotiations over a cargo incident have failed. It is the formal legal action through which the injured party (plaintiff) seeks monetary compensation from the carrier or freight forwarder (defendant). Common grounds in transport law include cargo loss or damage, late delivery, and improper handling of goods.
