Whether an injured party is fully compensated after a cargo incident depends largely on the amount of damages – the specific monetary sum the liable party must pay. The starting point is always the actual loss: the market value of lost or damaged goods, repair or replacement costs, and consequential losses such as lost profit. In practice, however, statutory or contractual liability caps often reduce the recoverable amount significantly, so the payment may fall well short of the full loss. The governing freight law – CMR, the Montreal Convention, or the HGB – determines both the calculation method and the applicable ceiling. Disputes over the amount are among the most frequent sources of conflict in transport.
