Liability of the principal for damages caused by vicarious agents (assistants who act in the performance of duties on behalf of the principal) to the extent the harm occurs in the execution of legal transactions or contractual duties. Under § 278 of the German Civil Code (BGB), the obligor is liable for the fault of their vicarious agents.
