Incoterms duty to mitigate damages

A contractual obligation under Incoterms requiring the parties to take reasonable steps to reduce or mitigate damages arising from non-performance, breach, or delays, so that liability is not unduly amplified. The costs of mitigation are generally borne by the party responsible for the damage, where permitted by law.
