Exemption from liability takes effect when a carrier, freight forwarder, or shipping line demonstrates that a recognised legal or contractual ground applies – for example, absence of fault, force majeure, or an explicit waiver clause in the transport contract. It serves as a risk-allocation tool: the parties agree in advance which categories of loss each side bears. The exemption covers only those damages expressly addressed; gross negligence and wilful misconduct are generally non-exculpable under most transport law regimes. Unlike a ground for exclusion of liability, which describes the triggering factual circumstances, exemption from liability refers to the legal outcome – the actual release from the duty to compensate.
