The clock is ticking for USA imports. The flat import surcharge of 10 percent is currently applicable only until July 24, 2026.

The USA introduced the surcharge on February 24, 2026. This is based on Section 122 of American trade law. This regulation allows the President to impose a temporary import duty of up to 15 percent, but only for a maximum of 150 days.

Without the consent of Congress, the current surcharge cannot simply be extended beyond this deadline. However, it is possible that the US government may employ other tariff instruments, such as Section 301 or product-specific tariffs.

This does not provide true relief for shippers and importers. The 10 percent rate could expire, be extended, or be replaced by other tariffs. What matters is not necessarily the departure date, but when the goods are declared for import in the USA.

For those planning shipments at the end of July, it is crucial to pay close attention. A container that is processed a few days earlier or later could fall under a different tariff regulation.

For shippers and freight forwarders, this means: Do not calculate U.S. shipments around July 24th with a fixed customs burden.

The actual import date, the HS code, the country of origin, and any potential special duties are important. In DDP transactions, it must also be clear who bears the risk of a short-term customs change.

In short: July 24th is a real deadline. What applies on July 25th has not yet been definitively clarified.

The 10% surcharge has been in effect since February 24, 2026.

The legal basis is Section 122 of the Trade Act of 1974.

The duration is limited to 150 days.

The current surcharge remains in effect until 12:01 AM Eastern Time on July 24, 2026.

Section 122 allows for a maximum tariff of 15%.

An extension beyond 150 days requires approval from the U.S. Congress.

Numerous goods are exempt. These include, among others, certain energy products, critical raw materials, and individual items under existing trade agreements.

Other tariffs, such as Section 232 or Section 301 duties, may also continue to apply additionally or independently.
