The amendment has been adopted but is not yet in effect. --- The EU Commission adopted a new version of the control list for dual-use goods on September 14, 2026. Dual-use means that a product can be used for both civilian and military purposes. Such goods, software, or technologies require authorization for certain exports. Newly included items include facilities and materials for semiconductor manufacturing, advanced computing chips, certain ceramic composites, and facilities for manufacturing silicon carbide fibers. Technology for gas turbines and additive manufacturing of energetic materials are also being added. The timing is important: The list has been adopted, but as of September 19 is not yet in force. The Council and European Parliament initially have a two-month review period. After that, the regulation must be published in the EU Official Journal. Work begins now for exporters and freight forwarders nonetheless. Article codes, technical descriptions, and existing commodity classifications should be reviewed. A machine previously exempt from authorization may fall under a new control number upon entry into force. This also applies to spare parts, software updates, or technical documentation. Responsibility for correct classification lies primarily with the exporter. However, the freight forwarder must not blindly rely on unclear goods descriptions. When warning signs appear—such as sensitive technology, unusual recipients, or problematic end-use—the shipment must be stopped and clarified. --- For sensitive technology, the dispatcher should request written export control clearance. Customs agents need the correct control number and, if necessary, an approval with the appropriate recipient and destination country. Existing standing orders should be reviewed before the regulation comes into effect to prevent goods from being held at the airport or terminal. In short: The new list does not yet apply, but anyone who only checks after it comes into effect will be too late. --- The EU Commission adopted the update on September 14, 2026. The legal basis is EU Dual-Use Regulation 2021/821. The list is contained in Annex I of the Regulation. Additional semiconductor and manufacturing technologies are newly included. Equipment for silicon carbide fibers is also listed. Council and Parliament have a standard two-month review period. Entry into force occurs only after publication in the EU Official Journal.
