When a WTO Panel issues a ruling in a trade dispute, the losing party may refer the case to the WTO Appellate Body. This standing tribunal of seven independent judges reviews questions of law only—not the underlying facts—and for decades provided a cornerstone of legal certainty in international trade. From 2017, the United States blocked the appointment of new members; by 2019, the body fell below the minimum quorum and was rendered effectively inoperative. For exporters and freight forwarders, the consequences are tangible: without a functioning appellate mechanism, tariff decisions or trade sanctions by a WTO member can no longer be definitively challenged, increasing legal exposure across international supply chains.
