Maintaining control over where US-origin technology ends up worldwide is the central purpose of the Export Administration Regulations (EAR). Administered by the Bureau of Industry and Security (BIS) within the US Department of Commerce, EAR governs the export, reexport, and in-country transfer of dual-use goods, software, and technologies – items with both civilian and potential military applications. Whether a licence is required depends on the item's classification on the Commerce Control List (CCL), the destination country, and the end user. Freight forwarders and exporters must determine whether their goods are subject to EAR and apply to BIS for a licence when necessary, particularly for shipments to restricted destinations or consignees on the Entity List or Denied Persons List. Violations can result in significant civil and criminal penalties, including loss of export privileges. EAR should not be confused with ITAR (International Traffic in Arms Regulations), which covers defence articles and is administered by the US State Department.
