# Tariff Engineering

As of July 2026 — Tariff engineering (duty-optimised product design) is the legal practice of deliberately designing a product's form, materials, composition or condition at importation so that it falls under a Harmonized Tariff Schedule (HTS) heading carrying a lower duty rate. It rests on a core principle of US customs law: goods are classified in their "condition as imported", and an importer may fashion merchandise so that the most favourable rate applies — affirmed since the Supreme Court ruling in Merritt v. Welsh (1881), where a sugar importer was allowed to adjust the colour of his product. The decisive test is "commercial reality": the design choice must be a genuine step in manufacturing with an independent commercial identity or use, not mere disguise. The line to criminal duty evasion (customs fraud under the Tariff Act of 1930) is thin — the Ford Transit Connect case is a warning: in March 2024 Ford paid about USD 365 million because removable "sham rear seats" falsely declared a cargo van as a passenger vehicle (2.5% instead of 25%). Amid high Trump tariffs and Section 232 and Section 301 rates, tariff engineering is gaining importance. Not to be confused with the First Sale Rule (reducing customs value) or country-of-origin planning via substantial transformation.
