# Punitive Tariff

> A punitive tariff (German: Strafzoll) is the colloquial name for an additional tariff levied as a trade-policy response to the conduct of another state or supplier — for example against dumping prices, unlawful subsidies, the infringement of intellectual property, or for political reasons.

A punitive tariff (German: Strafzoll) is the colloquial name for an additional tariff levied as a trade-policy response to the conduct of another state or supplier — for example against dumping prices, unlawful subsidies, the infringement of intellectual property, or for political reasons. The term is not a distinct legal concept: what the media call a "punitive tariff" is technically usually an antidumping duty, a countervailing duty, or a measure under US law such as Section 301 (against unfair trade practices, above all towards China) and Section 232 (national security). Punitive tariffs work by raising the landed cost of the affected imports and thus reducing their competitiveness; affected trade partners often respond with counter-tariffs, which can escalate into trade conflicts. In practice: because punitive tariffs are politically motivated and change quickly, importers must continually reconcile their product lists and countries of origin against the current measures. To be distinguished from the regular protective tariff, which permanently shields a domestic industry. Current note (as of July 2026): many of the IEEPA measures popularly called "punitive tariffs" (reciprocal tariffs, fentanyl tariffs on China, Canada and Mexico) were ruled unlawful by the US Supreme Court on 20 February 2026; the country surcharges have since run provisionally via Section 122, while the genuine trade-defence instruments Section 232 and Section 301, as well as antidumping and countervailing duties, remain in force.
