> Preferential-origin fraud is the deliberate falsification of origin certificates or customs declarations to unlawfully obtain tariff reductions under a preferential trade agreement.

Preferential-origin fraud is the deliberate falsification of origin certificates or customs declarations to unlawfully obtain tariff reductions under a preferential trade agreement. A common scheme: goods manufactured in Country X are declared as originating from Country Y, which holds a favourable preferential agreement with the importing country, allowing the operator to pocket the duty saving. Customs authorities uncover such schemes through physical inspections, administrative cooperation with the exporting country's authorities, or retrospective origin verification. Because fraud – unlike preferential abuse – requires intent by definition, it typically triggers duty recovery, substantial fines, and criminal prosecution. In serious cases, liability extends not only to importers but also to exporters who knowingly issued false certificates of origin.
