Unlike a chain of single-mode contracts – each governed by its own liability regime – a multimodal transport contract places the entire carriage under one contractual and legal responsibility. The multimodal transport operator (MTO) accepts liability for the whole journey, regardless of which sub-carrier caused the loss or damage. The document evidencing this contract is typically a multimodal transport document (MTD) or a combined bill of lading. Applicable liability limits are governed by national law or relevant international conventions and may vary depending on the stage of transit on which the damage occurred. Shippers favour this structure because it shifts the burden of inter-carrier recourse to the MTO and substantially reduces documentary complexity across the supply chain.
