A freight forwarder screens a shipment of precision instruments and discovers the consignee is a state defence procurement agency – that is when military end-use becomes the decisive legal question. Military end-use means that a good or technology is, or may be, used by armed forces, defence ministries, or other military end-users, whether or not the item appears on a controlled goods list. Export control regimes require exporters to obtain end-use certificates and to conduct due diligence on the intended destination and user. Under catch-all provisions, even unlisted items become licence-eligible once the exporter is aware of a potential military application. Diversion to unauthorized military purposes carries criminal liability and may result in denial of future export privileges.
