A consignee discovers damage upon delivery – and the immediate question is who bears responsibility. Logistics liability defines the legal and contractual obligations of freight forwarders, warehouse operators, and carriers toward their clients for loss, damage, or delay occurring during transport, storage, or handling. The governing legal framework depends on the mode of transport: road freight falls under the CMR Convention, sea freight under the Hague-Visby Rules, with national legislation such as the German Commercial Code (HGB) covering remaining gaps. Liability caps are the norm – standard contracts typically limit compensation to a fixed amount per kilogram of gross weight, which often falls well short of actual cargo value. Force majeure events, inadequate packing by the shipper, and the consignor's own negligence are generally excluded from liability. For high-value or sensitive shipments, separate cargo insurance is therefore essential.
