Unlike load securing as a purely technical measure, the load securing obligation is the statutory responsibility of shippers, freight forwarders, and drivers to ensure that goods cannot shift, fall, or overturn during transport. In road freight, the obligation derives from national road traffic legislation; the DIN EN 12195 standard series provides the recognised basis for calculating the restraint forces required. For cross-border dangerous goods movements, the ADR Agreement adds further requirements. Violations can result in fines, civil liability for cargo damage, and—where accidents cause personal injury—criminal proceedings. Because both shipper and carrier may face liability in the event of a claim, it is advisable to define contractually which party is responsible for each securing measure.
