A list rule of origin is a product-specific requirement set out in the origin protocol of a free trade agreement, prescribing – by HS tariff heading – exactly what processing or transformation a product must undergo to qualify as originating in a contracting country. The rules are arranged in tabular form according to Harmonized System nomenclature, which is where the name comes from. Common criteria include a change in tariff classification (the product shifts HS heading as a result of manufacturing), a minimum regional value content threshold, or a defined manufacturing operation. List rules differ from horizontal or general rules of origin, which apply uniformly across all product categories rather than product by product. Customs declarants and freight forwarders consult them when assessing whether an exporter can legitimately issue a preferential proof of origin.
