A shipment handled by three carriers across different modes arrives damaged – and no one can say exactly where the loss occurred. Joint carrier liability clauses address this scenario by making every participating carrier jointly and severally liable to the shipper for the full extent of loss, damage, or delay. The claimant need not identify which carrier was at fault; each can be pursued individually for full compensation, leaving the carriers to settle their internal allocation separately. These clauses appear in documents such as the CMR consignment note, the CIM waybill, or the bill of lading, as well as in general conditions of carriage. Shippers and forwarders should verify applicable liability caps before signing, and ensure cover is adequate relative to cargo value.
