Joint and several liability is a legal construct under which multiple debtors owe the same obligation, and the creditor may demand full performance from any one of them individually. In logistics, this situation arises regularly: if a shipment is damaged during a multimodal transport operation and a freight forwarder, a handling agent, and the main carrier all bear some responsibility, the claimant can pursue any single party for the entire compensation – regardless of that party's actual share of the fault. The debtor who pays is then entitled to seek contribution from the other co-debtors. For creditors, joint and several liability is advantageous because they need not establish the precise degree of fault of each party. For the businesses involved, however, it significantly increases exposure and makes adequate liability insurance essential. It differs from proportionate liability, where each party is responsible only for its own share.
