Carriers, freight forwarders, and shippers enter into a freight contract to define their mutual rights and obligations for the carriage of goods. The carrier undertakes to transport cargo from origin to destination and deliver it in unchanged condition; the shipper pays the agreed freight charges. The contract further governs liability limits, carriage conditions, claims procedures for loss or damage, and cargo preparation requirements. Which international legal framework applies depends on the mode of transport: the CMR Convention governs international road haulage, the CIM Uniform Rules apply to rail, and the Hague-Visby Rules or Hamburg Rules to sea freight depending on the agreement. A freight contract is distinct from a forwarding contract: the forwarder organises transport, whereas the carrier performs it.
