# Exporter

> A freight forwarder organises the shipment, but it is the exporter – the party that sells and dispatches goods to a foreign country – who bears legal responsibility towards the customs authorities of the country of export.

A freight forwarder organises the shipment, but it is the exporter – the party that sells and dispatches goods to a foreign country – who bears legal responsibility towards the customs authorities of the country of export. In practice the exporter is often the manufacturer, but a trading company acting in its own name qualifies equally. The exporter must ensure that all required export licences are in place, the customs declaration is accurate, and applicable embargo regulations and sanctions lists are observed. Under EU customs law, the exporter is referred to as the "declarant" and must generally be established in the EU to lodge an export declaration in their own name. The exporter should not be confused with the freight forwarder, who manages the logistical side on instruction and does not hold economic ownership of the goods.
