EU customs debt is the legally established payment obligation owed to the customs authority of an EU member state, arising when goods subject to import duties are brought into the customs territory of the Union or placed under a duty-triggering procedure. It covers import duties and anti-dumping duties, but not import VAT, which is assessed separately. The declarant is normally the primary debtor; in cases of irregular entry, joint and several liability may extend to other parties. The Union Customs Code (UCC) governs how customs debt is incurred, falls due, and is extinguished—under defined conditions it may be deferred, repaid, or remitted, for instance where goods demonstrably never entered the EU's economic circuit.
