Exporting controlled goods compliantly depends on a correct ECCN determination: the process of identifying which Export Control Classification Number applies to a product, software, or technology under the U.S. Export Administration Regulations (EAR). Each ECCN is a five-character alphanumeric code that classifies items by their military or dual-use relevance and determines whether a U.S. export license is required or whether a License Exception applies. The determination is the exporter's responsibility—not the freight forwarder's or the buyer's—and must be documented in writing. Misclassification constitutes a compliance violation and can result in substantial fines, denial of export privileges, and criminal liability. The ECCN should not be confused with the HTS or HS code, which govern customs tariff classification globally; the ECCN is specific to U.S. export control law.
