# Dual-Use Regulation

> Unlike purely national export control laws, the EU Dual-Use Regulation establishes a uniform legal framework across all member states, defining which goods, technologies, and software with dual civilian-military applications may be exported, brokered, or transited.

Unlike purely national export control laws, the EU Dual-Use Regulation establishes a uniform legal framework across all member states, defining which goods, technologies, and software with dual civilian-military applications may be exported, brokered, or transited. The current version, Regulation (EU) 2021/821, introduced human rights criteria and extended controls on cyber-surveillance technologies. Before each export transaction, a compliance officer verifies whether the relevant goods appear on Annex I of the Regulation, which type of licence – individual or general – is sufficient, and whether the end-user and destination country are cleared. Individual licences are issued by the competent national authority: BAFA in Germany, SECO in Switzerland. The Regulation applies not only to physical exports but also to technology transfers via electronic media or oral communication.
