# Border Seizure

> Border seizure is the customs procedure by which customs authorities detain goods suspected of infringing intellectual property rights.

Border seizure is the customs procedure by which customs authorities detain goods suspected of infringing intellectual property rights. The legal basis in the EU is Regulation (EU) No 608/2013. Rights holders file an application for action — in Germany electronically with the customs administration's central unit for intellectual property rights — after which customs holds back suspicious consignments at declaration or inspection. The declarant is informed; if no objection is raised, the goods are destroyed under a simplified procedure. For freight forwarders this means idle time, blocked shipments and official enquiries — a typical consequence of counterfeiting in the supply chain, especially with e-commerce imports from the Far East. Importantly, goods in transit or transhipment can also be affected. Not to be confused with a product-safety hold ordered by market surveillance authorities or with a seizure under criminal procedure.
