It is the hands-on party in the transport chain, yet it typically has no direct contractual relationship with the shipper. Its liability is governed by the principal carriage contract and the applicable conventions: CMR for road freight, the Hague-Visby Rules for sea, or the Montreal Convention for air. In multimodal operations, several actual carriers may handle successive legs without the shipper being aware. The shipper's legal recourse in the event of loss or damage lies with the contractual carrier, not with the individual subcontractors who physically performed the work.
