Abandonment in transport law is the formal relinquishment of cargo by its owner or another entitled party—triggered when a consignee refuses delivery, damage makes recovery economically unviable, or accruing storage charges exceed the goods' residual value. In marine insurance, abandonment carries particular legal weight: the insured may cede the damaged property to the insurer and claim the full insured value, provided the conditions for a constructive or actual total loss are met. In general freight law, abandonment gives rise to disposal costs and liability questions that must be resolved under the applicable transport convention or contract terms. Forwarders should therefore agree in advance on who bears the downstream costs when cargo remains unclaimed or unrecoverable.
